Issuance of Permanent Residence in Kenya is regulated by Sections 37, 38 and 39 of the Kenya Citizenship and Immigration Act, 2011. It grants long-term settlement rights to those who qualify under one of four categories.
Applies to Kenya citizens by birth who renounced Kenya citizenship, where their country of domicile denies them the opportunity to hold dual citizenship.
Lawful residents who have held work permits for a minimum of seven (7) years, and have been continuously resident in Kenya for three (3) years preceding the application, are eligible to apply.
Applies to children born to Kenyan parent(s) who also hold another nationality that does not allow dual citizenship, or who were born before the parent acquired Kenyan citizenship.
Applies to persons married to a Kenyan citizen for a period exceeding three years, where the marriage is bona fide.
